Terms for using the MelonsBot platform

The MelonsBot platform is operated by MelonTechs Establishment (MelonTechs), Commercial Registration No. 7015161941, Kingdom of Saudi Arabia ("we", "the platform"). These Terms of Service ("Terms") govern your access to and use of the platform. By using the platform or creating an account on it, you fully agree to these Terms. If you are using the platform on behalf of a business, you represent that you are authorized to agree to these Terms on its behalf.

1. Acceptance of terms

By using MelonsBot, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with the Privacy Policy and Refund Policy published on the platform. If you do not agree to any of these terms, you may not use the platform.

2. Description of the service

MelonsBot is a Software-as-a-Service (SaaS) platform that lets businesses automate WhatsApp conversations using artificial intelligence, including automated customer replies, catalog display (products, services, and properties), booking and appointment management, a unified team inbox, and integration with supported business platforms. We may add, modify, or discontinue features from time to time to develop the service.

3. Account and eligibility

You must be legally authorized to operate a business to use the platform. You are responsible for the accuracy of your account information, for keeping your login credentials confidential, and for all activity that takes place through your account. You must notify us immediately of any unauthorized use. We reserve the right to refuse or suspend any account that violates these Terms.

4. Subscription and billing

  • Trial: we offer a 7-day free trial with no card required. When it ends without a subscription, automated features (including the bot's automated replies) stop until you subscribe, while access to the account and the subscription page remains. We may offer a limited trial extension at our discretion.
  • Plans and renewal: the platform is offered through paid monthly subscription plans. Subscriptions renew automatically at the end of each billing cycle unless you cancel before renewal from your account settings.
  • Prices and tax: all prices are in Saudi Riyals and exclusive of Value Added Tax, which is added in accordance with the applicable laws of the Kingdom of Saudi Arabia. We may update prices without prior notice, with the update taking effect from the next billing cycle.
  • Refunds: refunds are governed by the Refund Policy published on the platform.

5. Acceptable use

You agree not to use the platform for any unlawful purpose or in violation of WhatsApp and Meta policies, including but not limited to: sending unsolicited (spam) messages or marketing messages without the recipient's consent; misleading, fraudulent, or otherwise unlawful or improper content; infringing the rights of others; or attempting to harm the platform or gain unauthorized access to it. You are responsible for the content sent by your account or by the bot on your behalf.

6. Customer data and WhatsApp/Meta compliance

For your end-customer data processed through the platform, we act as a processor on your behalf, and you are the controller responsible for having a lawful basis to process that data and for obtaining the necessary consents. You agree to use WhatsApp in accordance with Meta's official terms and policies, including the WhatsApp Business Policy, the messaging rules, and the 24-hour messaging window. Personal data is processed in accordance with our Privacy Policy and the applicable laws of the Kingdom, including the Personal Data Protection Law.

7. Intellectual property

The platform, its software, designs, and trademarks remain owned by us or our licensors. These Terms grant you only a limited, non-exclusive, non-transferable license to use the platform during your subscription period. Your content and business data remain yours, and you grant us a limited license to use them as necessary to operate and provide the service to you.

8. Third-party services

The platform relies on third-party services to provide some of its functionality, including Meta's WhatsApp Business API, the Tap payment provider for processing payments, and the Salla platform for e-commerce store integration. Your use of these services is subject to the terms and policies of their providers, and we are not responsible for their downtime or changes, or for any damage arising from third-party services beyond our control.

9. Disclaimer and limitation of liability

The platform is provided "as is" and "as available", without express or implied warranties as to being uninterrupted or error-free, or as to the accuracy of the automated AI output. You are responsible for reviewing and supervising the bot's output. To the extent permitted by law, we are not liable for indirect or consequential damages or lost profits, and our total liability — if any — is limited to the subscription amount paid during the three months preceding the event giving rise to the claim.

10. Termination and suspension

You may cancel your subscription at any time from your account settings. We may suspend or terminate your access if you violate these Terms or WhatsApp/Meta policies, or use the platform in a way that harms it or others, with notice to you where possible. On termination, automated features stop, with a reasonable period — where possible — to export your data in accordance with our policies.

11. Changes to the terms

We may modify these Terms from time to time. Material changes are communicated through the platform or by email, and the "Last updated" date above reflects the most recent version. Your continued use of the platform after the changes take effect constitutes acceptance of them.

12. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the applicable laws of the Kingdom of Saudi Arabia. In the event of any dispute that cannot be resolved amicably, the competent judicial authorities in the city of Makkah shall have jurisdiction.
